General Terms and Conditions of KRAGÜ GmbH
1. Scope of Application
The following General Terms and Conditions apply exclusively to the business relationship between KRAGÜ GmbH (hereinafter “KRAGÜ”) and the customer.
2. Prices
The prices are stated in euros, including the applicable statutory value-added tax. The VAT rate and amount are shown on the invoice.
3. Conclusion of the Contract
The presentation of goods in the KRAGÜ online shop constitutes merely a non-binding invitation to order goods from KRAGÜ.
By placing an order with KRAGÜ, you submit a binding offer to conclude a purchase contract.
KRAGÜ accepts the offer by delivering the ordered goods. The automatically generated order confirmation email does not constitute acceptance of the offer; it merely documents that the order has been received by KRAGÜ.
If KRAGÜ determines during the processing of your order that ordered products are unavailable, you will be informed by email.
4. Delivery
KRAGÜ delivers to the order address specified by the customer. Delivery is handled by DHL, DPD, or UPS. Delivery to post office boxes is excluded.
5. Warranty
The statutory warranty provisions apply.
6. Right of return
6.1. Right of revocation:
You may revoke your contractual declaration within 14 days without stating any reasons in text form, e.g. by letter, fax, or email, or—if the goods are provided to you before the period expires—by returning the goods.
However, the period does not begin before receipt of these instructions in text form, nor before the goods are received by the recipient, and also not before we have fulfilled our information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraphs 1 and 2 EGBGB and our obligations pursuant to § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To meet the revocation period, it is sufficient to send the revocation or the goods in good time. The revocation or return of the goods must be sent to:

6.2. Consequences of revocation:
In the event of an effective cancellation, the services received by both parties must be returned and any benefits derived from their use (e.g., interest) must be surrendered. If you cannot return or surrender to KRAGÜ the service received and any benefits derived from its use (e.g., advantages of use), either in whole or in part, or can do so only in a deteriorated condition, you must compensate KRAGÜ for the resulting loss in value.
You are only required to compensate for any deterioration of the item and benefits derived from its use insofar as the use or deterioration is attributable to handling the item beyond what is necessary to examine its properties and functionality. This means testing and trying out the respective product, as is possible and customary in a retail store.
Items that can be shipped as parcels must be returned at our expense and risk. Items that cannot be shipped as parcels will be collected from you.
Obligations to reimburse payments must be fulfilled within 30 days. For you, the period begins when you send your notice of cancellation or the item; for us, when we receive them.
6.3. Handling of Returns
Please note that return shipping costs are not covered by KRAGÜ GmbH and must be paid by the buyer.
7. Payment Methods
You can pay the purchase price in advance by transferring it to the specified account within 5 days of submitting the electronic order.
8. Data Protection
The customer's personal data that becomes known to KRAGÜ in the course of a business relationship will be stored and, for the purpose of processing the order, may be disclosed to affiliated companies. All data will, of course, be treated confidentially. The customer is aware of the possibilities of data disclosure in connection with the payment methods (Section 7 of these General Terms and Conditions).
KRAGÜ uses the data to provide the customer with further information about new products (email newsletter). If the customer does not wish to receive this, they can note this when placing the order or unsubscribe from the newsletter at any time afterward.
The data will not be used or disclosed for any further advertising purposes.
KRAGÜ will in all cases take the customer's legitimate interests into consideration.
9. Gift voucher
Activation and redemption
The KRAGÜ gift voucher is issued by KRAGÜ. The balance on the gift card can be redeemed, in whole or in part, exclusively in the online shop at http://www.kragu.de when making a purchase. The balance or remaining balance cannot be paid out in cash or earn interest.
Validity
The gift voucher is valid for 3 months from the date of purchase, beginning with the month following the purchase. The gift voucher can only be redeemed in the online shop.
Disclaimer of liability
The gift voucher is a bearer instrument and must be treated like cash. It may be used by anyone in possession of the gift voucher. Likewise, it can be redeemed in the online shop without identity verification. It is not possible to block the gift voucher. KRAGÜ accepts no liability for the voucher balance, particularly in the event of loss, illegibility, theft, or misuse, unless KRAGÜ or an employee is accused of intentional or grossly negligent conduct.
10. Voluntary exchange option
Regardless of your statutory right of withdrawal, KRAGÜ voluntarily gives you the opportunity to return products purchased from us. You may return all items purchased from the KRAGÜ online shop within 14 days of receipt without stating a reason, provided that the goods are complete and in unused and undamaged condition. The goods may only be inspected to the extent customary when trying them on in a retail store.
Please note that return shipping costs are not covered by KRAGÜ GmbH and must be paid by the buyer.
Furthermore, you are entitled to the statutory right of withdrawal described in Section 6.
